Adding Products to your basket does not reserve stock.

We reserve the right to refuse or cancel any Order before dispatch where:

  • a pricing error has occurred;
  • payment cannot be verified;
  • fraud is suspected;
  • legal restrictions apply;
  • delivery cannot be safely completed; or
  • fulfilling the Order would, in our reasonable opinion, compromise animal welfare.

Where an Order is cancelled before dispatch, any payment received will be refunded.


14. Customer Responsibilities

Before purchasing livestock, you agree that you have researched the species and can provide suitable long-term care.

You are responsible for ensuring:

  • your enclosure is fully prepared before delivery;
  • suitable heating, lighting and humidity are available where required;
  • appropriate food is available;
  • the species is legal to own at your location;
  • you comply with all applicable legislation;
  • someone is available to receive the delivery.

Failure to prepare appropriately may compromise animal welfare.

NaturesZion reserves the right to refuse or delay dispatch where we reasonably believe the welfare of the livestock may be at risk.


15. Animal Welfare

Animal welfare is central to everything we do.

Accordingly, we may postpone or cancel dispatch where necessary to protect livestock, including where:

  • weather conditions are unsuitable;
  • courier disruption creates an unacceptable welfare risk;
  • transport restrictions exist;
  • the health of the livestock requires additional observation;
  • biosecurity concerns arise.

Such delays are made solely in the interests of animal welfare and do not constitute a breach of contract.

We appreciate your understanding that the welfare of live animals will always take priority over delivery speed.

16. Dispatch of Orders

We aim to dispatch all Orders as promptly as possible. Dispatch times provided on our Website are estimates only and are not guaranteed.

Orders containing live livestock will only be dispatched on days that, in our reasonable opinion, provide the best opportunity for safe and successful delivery.

To protect animal welfare, we may delay dispatch where necessary.

Dispatch dates may be affected by, including but not limited to:

  • Extreme hot or cold weather.
  • Severe weather warnings.
  • Postal or courier disruption.
  • Public holidays.
  • Industrial action.
  • Reduced transport capacity.
  • Biosecurity concerns.
  • Animal health considerations.
  • Circumstances outside our reasonable control.

We will endeavour to keep customers informed of any significant delays.


17. Shipping Methods

Shipping methods are selected during checkout.

Available services may change without notice.

The delivery service selected does not guarantee a specific delivery time unless expressly stated by the courier.

Estimated delivery dates are provided for guidance only.


18. Delivery Address

Customers are solely responsible for ensuring that all delivery information provided is complete and accurate.

  • House number.
  • Street name.
  • Town or city.
  • County where applicable.
  • Postcode.

Orders dispatched to an incorrect address supplied by the Customer are entirely at the Customer’s risk.

Where an Order is returned due to an incorrect address, failed delivery, refusal of delivery or failure to collect, additional delivery charges may apply.

Customers purchasing live livestock must ensure that someone is available to receive the delivery on the expected delivery date.

Live animals should not be left unattended outdoors, in communal areas or exposed to unsuitable environmental conditions.

Failure to accept delivery may invalidate any Live Arrival Guarantee where permitted by law.


20. Delivery Times

Delivery estimates supplied by us or the courier are estimates only.

While we carefully select delivery services suitable for live livestock, delays occasionally occur.

NaturesZion is not responsible for delays caused by:

  • Royal Mail.
  • Courier partners.
  • Severe weather.
  • Road closures.
  • Vehicle breakdowns.
  • Industrial action.
  • Customs or border inspections.
  • Natural disasters.
  • Events outside our reasonable control.

Where delays occur, we will work with customers to resolve any issues as fairly as possible.


21. Weather Delays

Animal welfare always takes precedence over dispatch speed.

We reserve the absolute right to postpone the dispatch of live livestock whenever we reasonably believe that shipping conditions present an unacceptable risk.

This includes periods of:

  • Excessive heat.
  • Freezing temperatures.
  • Storm warnings.
  • Flooding.
  • Snow.
  • High winds.
  • Transport disruption.
  • Other adverse environmental conditions.

Such delays are made solely to protect the welfare of the livestock.

Customers are not entitled to compensation solely because dispatch has been postponed for welfare reasons.


22. Delivery of Live Livestock

All livestock is carefully inspected prior to dispatch.

Animals are packaged using methods designed to maximise their welfare during transport.

Packaging methods may include, where appropriate:

  • Insulated packaging.
  • Ventilated containers.
  • Heat packs.
  • Cooling materials.
  • Moisture-retaining materials.
  • Protective padding.

Packaging methods may vary according to species, season and weather conditions.

The exact packaging method used remains at our discretion.


23. Risk During Delivery

Risk in Products passes to the Customer upon successful delivery to the delivery address.

For live livestock, delivery is deemed to have occurred when the parcel is marked as delivered by the courier or handed to the recipient at the delivery address.

Customers should inspect deliveries as soon as reasonably possible.


24. Live Arrival Guarantee

Where expressly stated on our Website, eligible livestock may be covered by our Live Arrival Guarantee.

The Live Arrival Guarantee applies only where:

  • The correct shipping method has been selected where applicable.
  • The delivery address supplied is accurate.
  • Delivery is accepted at the first delivery attempt where reasonably possible.
  • The parcel is not redirected after dispatch.
  • The Customer follows all reporting requirements.
  • Weather delays have not been caused by Customer instructions.
  • The claim falls within the terms of our published Live Arrival Guarantee Policy.

The Live Arrival Guarantee does not create any rights beyond those expressly stated in that policy.


25. Dead on Arrival (DOA) Claims

If livestock arrives deceased, the Customer must notify us as soon as reasonably possible in accordance with our Live Arrival Guarantee.

Claims must include clear evidence requested by us, which may include:

  • Photographs of the unopened package.
  • Photographs of the packaging contents.
  • Clear photographs of the deceased livestock.
  • Photographs showing the condition of the packaging.
  • Courier tracking information where available.

We reserve the right to request additional information where necessary to assess the claim.

Failure to provide sufficient evidence may result in the claim being declined.


26. Delayed Reporting

Livestock naturally deteriorates after death.

Accordingly, delayed reporting may make it impossible to determine the cause or timing of death.

Claims submitted outside the reporting period specified within our Live Arrival Guarantee Policy may be declined unless required otherwise by applicable law.


27. Incorrect Husbandry After Delivery

Once livestock has been successfully delivered alive, responsibility for its ongoing care passes to the Customer.

We cannot accept responsibility for illness, injury or death resulting from:

  • Incorrect temperatures.
  • Incorrect humidity.
  • Unsuitable enclosure conditions.
  • Inappropriate diet.
  • Poor hygiene.
  • Mixing incompatible species.
  • Escape.
  • Predation by other animals.
  • Chemical exposure.
  • Accidental injury.
  • Neglect.
  • Any other husbandry issue outside our control.

Care information provided by NaturesZion is intended as general guidance only and does not replace responsible research by the keeper.


28. Natural Variation

Live animals are not manufactured products.

Natural differences exist between individuals.

These may include:

  • Colour intensity.
  • Markings.
  • Size.
  • Body proportions.
  • Growth rate.
  • Behaviour.
  • Appetite.
  • Temperament.
  • Activity levels.
  • Reproductive maturity.

Such differences are expected and do not constitute faults.


29. Sexing

Unless expressly stated otherwise, livestock is sold as unsexed.

Where animals are advertised as male, female or pairs, we make every reasonable effort to determine sex accurately.

However, occasional errors may occur, particularly with juvenile animals or species that are difficult to sex.

Sexing errors made in good faith do not automatically entitle the Customer to compensation beyond any rights available under applicable consumer law.


30. Breeding Colonies and Starter Cultures

Starter colonies, cultures and breeding groups are sold to establish future populations.

Population growth cannot be guaranteed.

Breeding success depends upon numerous factors outside our control, including:

  • Husbandry.
  • Temperature.
  • Humidity.
  • Nutrition.
  • Genetics.
  • Environmental conditions.

Accordingly, we cannot guarantee breeding success, growth rates or future population size.


31. Live Plants and Natural Products

Live plants, mosses, wood, bark, leaf litter and other natural materials are naturally variable products.

Customers acknowledge that:

  • Shape varies.
  • Colour varies.
  • Size varies.
  • Texture varies.
  • Natural imperfections occur.
  • Seasonal variation occurs.

Natural products may contain harmless organic variation despite careful preparation.

Such variation does not constitute a defect.


32. Biosecurity

Customers should quarantine new livestock where appropriate before introducing them into existing collections.

NaturesZion cannot accept responsibility for losses arising from failure to follow appropriate quarantine or biosecurity procedures.

We reserve the right to refuse sales where we reasonably believe biosecurity may be compromised.

33. Consumer Rights

Nothing within these Terms and Conditions excludes, restricts or limits any statutory rights that you may have under applicable UK consumer protection legislation, including but not limited to the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where any provision of these Terms conflicts with applicable law, the relevant legislation shall prevail to the extent of that conflict.


34. Order Cancellations

Orders may only be cancelled before dispatch.

Once an Order has been dispatched, it cannot normally be cancelled.

Customers wishing to cancel an Order before dispatch should contact us as soon as possible.

Where dispatch has not commenced, we will endeavour to accommodate cancellation requests.

Refunds for cancelled Orders will be processed using the original payment method.


35. Right to Cancel

Under the Consumer Contracts Regulations 2013, certain products are exempt from the statutory cooling-off period.

These exemptions include, but are not limited to:

  • Live animals.
  • Perishable goods.
  • Products liable to deteriorate rapidly.
  • Sealed goods which are unsuitable for return for health or hygiene reasons once opened.
  • Custom-made or personalised items.

Where cancellation rights apply, they are subject to applicable legislation and our Refund and Returns Policy.


36. Returns

Our Returns Policy forms part of these Terms and Conditions.

Customers should refer to our separate Refund and Returns Policy before requesting a return.

No Products should be returned without prior authorisation.

Unauthorised returns may be refused.

Customers are responsible for ensuring returned Products are packaged appropriately unless otherwise agreed.


37. Refunds

Refunds will be considered in accordance with:

  • UK consumer law.
  • Our Refund and Returns Policy.
  • Any applicable Live Arrival Guarantee.

Where a refund is approved, it will normally be made using the original payment method.

We reserve the right to refuse refunds where claims are fraudulent, misleading or unsupported by appropriate evidence.

Nothing in this section limits your statutory rights.


38. Exchanges

Replacement Products may be offered instead of refunds where appropriate and where agreed by both parties.

Availability cannot be guaranteed.

Where identical Products are unavailable, suitable alternatives or refunds may be offered.


39. Refusal of Service

We reserve the right to refuse future sales where we reasonably believe that a customer has:

  • Submitted fraudulent claims.
  • Attempted payment fraud.
  • Abused chargeback procedures.
  • Abused our Live Arrival Guarantee.
  • Harassed or threatened staff.
  • Deliberately provided false information.
  • Breached these Terms and Conditions.
  • Acted in a manner likely to compromise animal welfare.

Any such decision will not affect statutory rights relating to previous purchases.


40. Fraud Prevention

We actively monitor Orders for fraudulent activity.

We reserve the right to:

  • Verify identity.
  • Request additional information.
  • Delay dispatch pending verification.
  • Cancel suspicious Orders.
  • Report suspected fraud to relevant authorities.

Knowingly submitting false claims may constitute fraud.


41. Chargebacks

Customers agree to contact NaturesZion first to allow a reasonable opportunity to resolve any concerns before initiating a payment dispute or chargeback.

Nothing in this clause limits your legal right to dispute a payment through your payment provider where appropriate.

Where a chargeback is initiated fraudulently or without reasonable grounds, we reserve the right to provide all relevant evidence to the payment provider.


42. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability which cannot legally be excluded.

Subject to the above, and to the fullest extent permitted by law:

  • We shall not be liable for indirect or consequential losses.
  • We shall not be liable for loss of profits, business, goodwill or anticipated savings.
  • We shall not be liable for losses arising from incorrect husbandry after delivery.
  • We shall not be liable for losses resulting from circumstances outside our reasonable control.

Where liability is established, our total liability shall not exceed the price paid for the relevant Product, except where applicable law provides otherwise.


43. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control.

Such events include, but are not limited to:

  • Severe weather.
  • Flood.
  • Fire.
  • Pandemic.
  • Disease outbreaks.
  • Government restrictions.
  • Industrial action.
  • Transport disruption.
  • Power failures.
  • Cyber attacks.
  • Telecommunications failures.
  • Natural disasters.
  • Civil unrest.

Where such events occur, our obligations shall be suspended for the duration of the disruption.
